1. Agreement to Terms

By accessing or using Feedvault ("the Service"), operated by ERIK GLOBAL VENTURES LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Feedvault is a web-based application that allows users to organize their YouTube subscriptions into focused, customizable lists. The Service provides tools for importing YouTube channels, creating curated lists, and viewing recent uploads from selected channels in a distraction-free interface.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian to use the Service.

4. Account Registration

To access certain features of the Service, you must create an account using Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions and Payments

Feedvault offers paid subscription plans. All payments are processed through Creem, our Merchant of Record ("MOR"). By subscribing to a paid plan, you agree to the pricing and payment terms presented at the time of purchase. Creem handles all billing, payment processing, tax collection, and related compliance as the MOR.

6. Pre-Sale Terms

Feedvault may offer pre-sale pricing for early supporters. Pre-sale purchases grant access to the Service at a discounted rate. If the Service does not launch or is discontinued before launch, all pre-sale customers will receive a full refund. Pre-sale pricing is subject to change and may be limited in availability.

7. Refund Policy

We offer a 30-day money-back guarantee on all purchases. If you are not satisfied with the Service, you may request a full refund within 30 days of your purchase date by contacting us at [email protected]. Refunds are processed through Creem and may take 5-10 business days to appear on your statement. For more details, please see our Refund Policy.

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Attempt to gain unauthorized access to the Service or its related systems
  • Use the Service for any fraudulent or malicious purpose
  • Interfere with or disrupt the integrity or performance of the Service
  • Scrape, crawl, or use automated means to access the Service without our express permission
  • Resell, redistribute, or sublicense access to the Service

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by ERIK GLOBAL VENTURES LLC and is protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you create within the Service (such as list names and configurations). By using the Service, you grant us a limited license to store and display your content solely for the purpose of providing the Service to you.

10. Third-Party Services

The Service integrates with third-party services, including YouTube API Services and Google OAuth. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, policies, or practices of any third-party services. By using the Service, you also agree to be bound by the YouTube Terms of Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERIK GLOBAL VENTURES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in Delaware.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
